TERMS OF SERVICE
This website is operated by OptiGearWild. Throughout the site, the terms “we”, “us” and “our” refer to OptiGearWild. We offer this website, including the information, tools, and services available from this site to you, conditioned upon your acceptance of the terms, conditions, policies, and notices stated here. By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms of Service apply to users of the site.
SECTION 1 - ONLINE STORE CONDITIONS & ELIGIBILITY
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or territory of residence within the United States. You may not use our premium camping gear, wilderness tools, or high-performance survival equipment for any illegal or unauthorized purpose, nor may you violate laws in your jurisdiction. A breach or violation of any of the Terms will result in a termination of your Services.
SECTION 2 - PRICING, PRODUCTS AND VARIANT CONFIGURATIONS
Prices for our products are subject to change without notice. Certain products—including our variant configurations of outdoor tents, windproof alpine stoves, and wilderness survival kits—are available online through the website. These products may have limited quantities and are subject to return or exchange pursuant to our Shipping, Delivery & Returns Policy. We reserve the right to manage the sales or quantities of our products to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 3 - ORDER PROCESSING AND ACCOUNT CONDITIONS
We reserve the right to refuse, limit, or manage orders placed with us pursuant to internal risk metrics. These standard parameters may include orders placed by or under the same customer account, and/or orders that use the same billing and/or shipping address. You agree to provide current, complete, and accurate purchase and account information for transactions made at our store, and to promptly update your email and payment details as needed to support smooth transaction routing.
SECTION 4 - FULFILLMENT, SHIPPING, AND DELIVERY VALIDATION
Product orders completed through our Service are managed under our standard shipping logistics protocols. We aim to support the dispatch of your selected outdoor equipment under tracking validation, maintaining an estimated delivery window of 5 to 10 business days to your designated contiguous United States destination address.
Pursuant to domestic merchant compliance frameworks, final transactional delivery validation remains anchored to official carrier data logs provided by our designated domestic logistics networks. Carrier-logged delivery validation constitutes contractual fulfillment of our Service, and we maintain no liability for packages once marked as delivered, signed for, or supported by delivery confirmation data at your designated destination coordinates.
SECTION 5 - PROHIBITED USES
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate federal, provincial, or state regulations, rules, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of third parties; (d) to submit false or misleading information; (e) to upload viruses or malicious code; (f) to collect or track the personal information of others; (g) to spam, phish, crawl, or scrape; or (h) to interfere with the security features of the Service or the Internet. We reserve the right to terminate your use of the Service for violating any prohibited uses.
SECTION 6 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The service and products delivered to you are provided 'as is' and 'as available' for your use, without warranties of any kind, either express or implied, including implied warranties of merchantability, durability, fitness for a particular purpose, and non-infringement. In no case shall OptiGearWild, our directors, officers, employees, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of the service or any products procured.
SECTION 7 - GOVERNING LAW & JURISDICTIONAL COMPETENCE
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, construed, and enforced in accordance with the federal laws of the United States and the applicable state laws governing the State of Oregon, without regard to its conflict of law principles. Any legal action, dispute, or claim arising out of or relating to these Terms shall be brought exclusively before a court of competent jurisdiction within the State of Oregon, United States.
